Introduction

ACHPR, the African Commission on Human and Peoples’ Rights, is the main AU institution charged with monitoring the implementation of the African Charter on Human and Peoples’ Rights.

It examines cases of violations perpetrated by states party to the Charter and makes its recommendations, findings, or legal opinions on them.

Step 1: Complete the Official Complaint Form

Individuals seeking to make complaints must fill out the ACHPR communications form online.

Step 2: Comply with Language Requirements

Communications are supposed to be in any of the following languages:

English
French
Portuguese
Arabic

Step 3: Observe the Page Requirement

Communications should not be more than 35 pages long except where annexed documents are being submitted.

Step 4: E-mail the Complaint Forms

Complaint forms should then be mailed to the Commission electronically.

According to the Commission, it is unnecessary to send hard copies separately after electronic filing.

For an investigation to begin, a complaint will need to include:

Full name and signed statement of the complainant
Their nationality and job description
State responsible for violations according to the allegations
Full details about the abuse reported
When and where each violation occurred
Proof of having tried local legal remedies first

The Commission allows complainants to request confidentiality where needed.

Important Conditions Before Making the Complaint

Every complaint cannot automatically be processed by the ACHPR.

ACHPR only considers complaints made against states that have signed the African Charter on Human and Peoples’ Rights.

Complaints should also prove that domestic legal procedures are no longer feasible in the country.

Anonymous complaints are not usually accepted, but anonymity can be maintained publicly under certain conditions.
