ICC says that El Hishri held authority over one part of the complex where women and children had been detained.

What Is the Timeline of Alleged Activities?
The crimes that form the basis of the allegations occurred between May 1, 2014, and June 30, 2020.
El Hishri was arrested by German authorities at Berlin Brandenburg Airport on July 16, 2025, following issuance of an ICC arrest warrant against him.
He was then surrendered to the ICC and appeared before the court’s judges.
Exactly one year after his arrest, on July 16, 2026, ICC Pre-Trial Chamber I confirmed all the charges against him and referred the case to trial.
Khaled El Hishri: What Crimes Is He Accused Of?
El Hishri is accused of committing 17 war crimes and crimes against humanity.
The allegations relate to Libyan and non-Libyan detainees, which include migrants and refugees, who have allegedly suffered extreme torture while in detention.
Among the listed war crimes and crimes against humanity:
- Violence against detainees in the form of torture and cruel treatment.
- Violence against detainees in the form of sexual violence, including rape.
- Violence against detainees in the form of murder and attempted murder.
- Violence against detainees in the form of deprivation of liberty.
- Other inhumane acts that include enslavement, persecution and outrages upon personal dignity.
These are all accusations that will have to be proven beyond a reasonable doubt during a trial. El Hishri is presumed innocent until proven guilty before the ICC.
Significance of the Mitiga Prison Complex?
Mitiga is one of the major detention centers in Libya. It has already received some attention due to allegations of mistreatment of the detainees there.
This prison complex is situated inside the Mitiga airport complex in Tripoli.
In particular, this is especially relevant in terms of the fact that the charges regarding abuse concerning the individuals are brought to an international court and not to Libya’s highly divided domestic judicial system.
